Sketti Terms of Use
Effective date: August 31, 2026
Company: Sketti, Inc., a Delaware corporation based in San Francisco, California (“Sketti,” “we,” “us”). Mailing address: 2261 Market Street #90683, San Francisco, CA 94114.
Contact: support@sketti.ai
By creating an account or using Sketti, you agree to these Terms of Use and to our Privacy Policy at sketti.ai/privacy, which is incorporated by reference. If you do not agree, do not use the service. These Terms contain an arbitration agreement and class-action waiver in Section 15 that affect how disputes are resolved; please read it.
1. What Sketti is
Sketti is a real-time teaching assistant. As you teach, it transcribes what is said and generates supporting visuals, explainers, and post-lesson study guides. Outputs are generated by AI and are intended to support a human educator, not replace one.
2. Eligibility
You must be at least 18 years old to create an account. Sketti is offered for use in instructional settings by classroom teachers, private tutors, and homeschooling parents/guardians who are educating students. Students never create accounts and may not use Sketti except through an educator’s account during a lesson. If you use Sketti with students, you are responsible for having the authority and any consents required to do so (see Section 8). Sketti is intended for use in the United States only.
3. Accounts and plans
Teacher (free for 1 year). Free access is available to verified U.S. K, 12 teachers for 12 months. To obtain it you must provide your school/institution and your school email, and you must certify that you are a U.S. K, 12 teacher. You agree that your free access may be suspended or revoked at any time if that certification is untrue or if we cannot reasonably confirm your eligibility. Free access is a revocable, time-limited license, not a right; at the end of the free period, continued use requires a paid plan. Free teacher access does not convert automatically to a paid subscription, and we will not charge you unless you affirmatively subscribe (we may notify you before your free access ends).
Paid plans. Tutors, homeschool parents, and others use Sketti on a paid subscription at the price and billing frequency shown at checkout or on our pricing page. Misrepresenting yourself as a teacher to avoid payment is a breach of these Terms and may result in termination.
You are responsible for your account credentials and all activity under your account. Tell us promptly at support@sketti.ai if you believe your account has been accessed without authorization.
4. Teacher eligibility attestation
When you request free teacher access, you represent and warrant that: (a) you are an employed teacher at a U.S. K, 12 school or district; (b) the institution you provided is accurate; (c) your school or district permits you to use Sketti for classroom instruction; and (d) you understand we may verify your status, now or later, including through third-party verification services, and may revoke free access if your attestation is false; and (e) any school administrator contact you provide is a person authorized to approve educational services on behalf of your school, and the contact information is accurate. We rely on this representation and on the acknowledgment we receive, but we do not verify that individual’s internal authority; you are responsible for the accuracy of the contact you provide. Providing false eligibility information is grounds for immediate termination.
5. Payments, renewal, and cancellation
This Section applies if and when you purchase a paid subscription. Paid plans are not available at launch; while your access is free, nothing in this Section applies to you and no payment method is required.
Automatic renewal notice. Paid plans renew automatically. Before you subscribe, we will show you the price, the billing frequency, that the plan renews until cancelled, and how to cancel, and you must affirmatively agree to those terms. We will send you an acknowledgment with the same information and a cancellation link after you subscribe.
Paid subscriptions are billed in advance at the frequency shown at checkout through our payment processor (Stripe). By subscribing you authorize recurring charges of the amount and at the frequency shown at checkout to your payment method until you cancel.
Subscriptions renew automatically at the end of each billing period. You may cancel anytime online through your account settings, without having to contact customer service by phone or provide a reason; cancellation takes effect at the end of the current billing period, and you will keep access until then.
Refunds: New paid subscribers may request a full refund within 14 days of their first charge (a 14-day money-back guarantee) by emailing support@sketti.ai. After that window, fees are non-refundable except where required by law, and cancellation stops future charges at the end of the current billing period.
We may change pricing on a prospective basis with between 7 and 30 days’ notice by email that also tells you how to cancel; the new price applies to your next renewal after the notice period, and you may cancel before then.
Once a year we will send you a reminder, by email, of the plan you are on, what it costs and how often you are charged, and how to cancel.
6. Acceptable use
You agree not to: use Sketti for any unlawful purpose; input content you don’t have the right to use; use Sketti with a student for whom the authorization or consent required by Section 8 has not been obtained; enter a student’s name, contact details, or other identifying information as lesson context; attempt to access non-public areas, other users’ data, or our systems; reverse engineer or scrape the service; resell or sublicense access; or use outputs in a way that is deceptive, harmful, or infringing. We may suspend accounts that violate these Terms.
7. Your content, and AI-generated output
Your inputs. You retain ownership of the lesson content, transcripts, and materials you provide (“Inputs”). You grant us a limited license to process Inputs to operate and provide the service, subject to our Privacy Policy. We do not use student audio, classroom transcripts, or other student personal information to train or fine-tune any AI models, and we do not use student personal information for our own purposes. The AI providers we send this content to are contracted directly and are bound not to use student personal information to train their models or for their own purposes. Our hosting platform is bound to use student personal information only to provide its service to us. One exception, which we disclose rather than promise around: speech-to-text is performed today by the speech-recognition service built into your browser, which we do not contract with. That vendor’s handling of the audio is governed by its own terms, and we cannot make this commitment for that step. See Section 5 of our Privacy Policy. To improve Sketti we use only de-identified product signals - see the Privacy Policy. For classroom use, student data belongs to the school, and we hold it on the school’s behalf.
Outputs. As between you and Sketti, you own the visuals, explainers, and study guides Sketti generates from your Inputs (“Outputs”), and you may use them for your instructional purposes, and we assign to you whatever rights we may have in them. Purely AI-generated material may not be eligible for copyright protection under U.S. law, so ownership “as between you and us” does not guarantee you hold an enforceable copyright against third parties. Because Outputs are generated independently for each user, similar or identical Outputs may be generated for other users, and your ownership does not extend to those.
AI limitations - important. Outputs are generated by AI and may be inaccurate, incomplete, or inappropriate. Your right to use Outputs with students is conditioned on your reviewing each Output before you present it or rely on it. Sketti is a support tool; the educator remains responsible for what is taught. We make no warranty that Outputs are accurate or fit for any particular curriculum or standard.
8. Students, minors, and privacy
Sketti may be used in settings involving students, including minors. You are responsible for ensuring you have the authority and any consents required by applicable law (including FERPA, COPPA, and state student-privacy laws) before using Sketti with students, and for complying with your school’s or district’s policies. Because the required consent differs by role:
Classroom teachers using Sketti on behalf of a school rely on the school’s authorization; we act as the school’s service provider and a FERPA “school official,” and we are prepared to enter into a district data-privacy agreement where required. You represent that your school or district has authorized your use of Sketti for classroom instruction and that you will stop using Sketti with students if that authorization is withdrawn. If your school or district signs a data-privacy agreement with us, that agreement controls over these Terms as to student data.
Homeschooling parents/guardians provide any required consent for their own child directly. You represent that you are the parent or legal guardian of each child you teach with Sketti.
Private tutors are not a school and cannot consent on behalf of another person’s child. If you are a tutor using Sketti with a child under 13, you must add the child to your account and provide the parent’s or guardian’s contact information so that we can obtain verifiable parental consent directly from the parent, as described in Section 3 of the Privacy Policy. You may not use Sketti with a child under 13 until we have recorded that consent, and you must stop if the parent withdraws it. You are responsible for accurately identifying each child under 13 and for providing correct parent contact information.
Recording and notice. Sketti listens to a lesson only while you start and run a session. State laws differ on whether everyone whose voice may be captured has to be told, and whether their consent is required; several states require the consent of everyone present. You are responsible for telling everyone in the room that Sketti is listening, and for obtaining any consent your state requires, before you start a session. Do not start a session where you cannot give that notice.
How student data is handled is described in our Privacy Policy at sketti.ai/privacy, including the rights of schools, parents, and guardians to review and delete student information.
9. Intellectual property
Sketti, its software, design system, and content (excluding your Inputs and Outputs) are owned by us or our licensors. These Terms grant you a limited, revocable, non-transferable, non-exclusive license to use the service for your own instructional purposes; no other rights are granted. If you send us feedback or suggestions, we may use them without obligation to you.
10. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that Outputs will be accurate or suitable. Outputs are instructional support. They are not professional, medical, psychological, legal, or safety advice, are not a substitute for your own professional judgment or your school’s curriculum standards, and should not be relied on for high-stakes decisions about a student. Some states do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in this Section limits the commitments we make about student data in Section 8 and the Privacy Policy.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service will not exceed the greater of the amounts you paid us in the 12 months before the claim or $100. These limits do not apply to our liability for gross negligence, willful misconduct, or fraud; to any liability that cannot be limited under applicable law; or, for a school or district customer, to the extent a signed data-privacy agreement provides otherwise.
12. Indemnification
You agree to indemnify and hold us harmless from third-party claims (including reasonable attorneys’ fees) arising out of your Inputs, your use of Sketti with a student without the authorization or consent required by Section 8, or your violation of these Terms or applicable law. This Section does not apply to claims caused by our own breach of these Terms or the Privacy Policy.
13. Termination
We may suspend or terminate your access at any time for breach of these Terms, including a false teacher attestation or non-payment, or if a required school authorization or parental consent is withdrawn. You may stop using the service and close your account at any time. On termination we handle your data as described in Section 6 of the Privacy Policy. Sections 7 through 15, and any other sections that by their nature should survive termination will survive.
14. Changes to these Terms
We may update these Terms. Material changes will be notified by email and in the service at least 30 days before they take effect and take effect on the stated date. Continued use after the effective date means you accept them; if you do not agree, cancel before then and any prepaid unused period will be refunded.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs Section 15(b). This choice does not take away protections you have under the consumer-protection or privacy laws of the state where you live.
(a) Talk to us first. Before starting a formal dispute, send a written description of the problem to support@sketti.ai (or, for us to you, to your account email). The parties will try in good faith to resolve it within 45 days.
(b) Arbitration and class-action waiver. If the dispute is not resolved informally, any claim relating to these Terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court or seek an injunction to protect intellectual property. Arbitration will take place by video, by phone, or in the county where you live, and we will pay all arbitration filing and arbitrator fees above $100 for claims under $10,000. You and Sketti each waive any right to a jury trial and to participate in a class or representative action. You may opt out of this arbitration agreement by emailing support@sketti.ai with your name and account email within 30 days after you first accept these Terms.
(c) Courts. If the arbitration agreement is found not to apply, or for a school or district customer whose data-privacy agreement provides otherwise, claims will be brought in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction.
(d) Coordinated filings. If 25 or more similar arbitration demands are brought against Sketti by or with the help of the same lawyer or coordinated group, they will be treated as a coordinated filing and resolved as follows. The demands will be batched in groups of no more than 50, and the parties will select one arbitrator for each batch. The parties will first arbitrate a small number of representative cases from the first batch (no fewer than five, chosen half by you and half by us), and will then attempt in good faith to resolve the remaining demands in that batch using what those cases decide, with a single mediator if either party asks for one. Filing and arbitrator fees are payable batch by batch as each batch begins, not for all demands at once. Any limitation period is paused for all demands in the coordinated filing while this process runs. If a court or the arbitration provider holds this subsection unenforceable, the coordinated filings will proceed in court rather than in arbitration, and Section 15(c) applies. Nothing in this subsection changes our obligation to pay fees under Section 15(b) or your right to opt out of arbitration.
